Sarrogate Mother

Unique Fertility Care- Delivering Happiness

A surrogate mother is one who lends her uterus to another couple so that they can have a baby, the word "surrogate" meaning substitute or replacement.

Surrogacy is an arrangement in which a woman carries and delivers a child for another couple or person. This woman, the surrogate mother, may be the child's genetic mother (called traditional surrogacy), or she may be genetically unrelated to the child (called gestational surrogacy).

There are two main kinds of surrogacy:-

  1. Traditional surrogacy, where the surrogate mother provides the egg. In this case, the surrogate is inseminated artificially by the husband's sperm. In this case, the infertile woman has no genetic relationship to the baby. This is not allowed legally in India at present.
  2. Gestational surrogacy, where the infertile woman (or an egg donor) provides the egg, which is then either transferred to the surrogate mother by GIFT along with her husband's sperm; or fertilized in vitro by IVF with her husband's sperm and an embryo transfer performed to the surrogate's uterus, which then acts as an incubator for the next nine months. As gestational surrogacy requires the implantation of a previously created embryo, and for this reason the process always takes place in a clinical setting.

Certain guidelines have been laid down to try to minimize misuse of the surrogacy technique; and a surrogate motherhood contract needs to be drawn up, which should specify that the child will become the legitimate adopted child of the infertile couple, i.e, the intended parents. This needs to be signed by the couple, the surrogate, and her husband.

The intended parent or parents, sometimes called the social parents, may arrange a surrogate pregnancy because of homosexuality, female infertility, or other medical issues which make pregnancy or delivery impossible, risky or otherwise undesirable. The intended parent may also be a single man wishing to have his/her owns biological child, or a single woman unable to take a pregnancy to full-term. The sperm or eggs may be provided by the 'commissioning' parents, but donor sperm, eggs and embryos may also be used.

Surrogacy is legal in India

Surrogacy in India is much simpler and cost effective than anywhere else in the world.

There is an increasing amount of Intended Parents who choose India as their surrogacy destination. The main reason for this increase is the less costly surrogacy and better flexible laws Indian clinics are at the same time becoming more competitive, not just in the pricing, but in the hiring and retention of Indian females as surrogates.

Clinics charge patients between $20,000 and $30,000 for the complete package, including fertilization, the surrogate's fee, and delivery of the baby at a hospital. Important point to note is that if an egg donor is involved, her name does not appear on the document but only that of the father.

Under guidelines issued by the Indian Medical Council, surrogate mother signs away all their rights to the child. In cases where the surrogate provides a womb for an embryo formed from the sperm and egg of the prospective parents, it is only the names of these genetic parents that appear on the birth certificate. Intended Parents are requested to find out prevailing laws in their country or from their respective consulate in New Delhi to facilitate and expedite the process to carry their baby back to their hometown. UFC also offer to help them with contact with a lawyer to expedite their paperwork.
